TERMS OF USE FITVYR COACH

These terms apply to the use of the FITVYR Coach app and its subscriptions. Last updated: October 27, 2026.

1. Provider

The provider of the app is SRO Intelligence Services e.K. (FITVYR brand), owner Joshua Bez, Meraner Str. 34c, 86356 Neusäß, Germany, Local Court of Augsburg (Amtsgericht Augsburg) HRA 18932, email support@fitvyr.de.

2. What the app does

FITVYR Coach recognizes your movement through your phone's camera, counts reps, gives cues on how to perform exercises, evaluates sets and supports you with a training plan and progress overview. The scope depends on the subscription you choose; the app shows which components a subscription includes before you buy.

Not a medical device, no advice: The app does not replace medical, physiotherapeutic or other therapeutic advice. The cues are general training cues based on camera recognition, which can make mistakes. If you have symptoms, pre-existing conditions or injuries, check with a doctor before training to find out what is suitable for you. Listen to your body and stop if you feel pain.

Safety at the machine: Set up your phone so that it cannot fall over or get in anyone's way. Follow the safety instructions of the machine manufacturer.

3. Subscriptions, prices and term

You take out subscriptions in the app through Apple's App Store or Google Play. The payment contract is concluded under the terms of Apple or Google; the prices the store shows you before purchase are decisive. Subscriptions run monthly or yearly and renew automatically for the same term unless you cancel in time.

You can cancel at any time, effective at the end of the current term, in the subscription settings of your Apple account or in Google Play – with Apple at the latest 24 hours before expiry. Deleting the app does not end a subscription.

Free periods and offers (such as “6 months free”) apply only as long as they are offered in the store and only once per account. If you do not cancel before the end of the free period, the subscription converts into the paid subscription shown to you when you signed up.

Withdrawal and refunds are governed by the rules of Apple or Google. Statutory rights to which you are entitled as a consumer remain unaffected.

4. AI summary

After you give your consent, an AI writes a short summary from the key figures of the set after each set. These texts are generated automatically, may be inaccurate and are not personal advice. To keep the service available to everyone, the number of AI summaries per day is limited. Without AI, the app shows a summary that it creates itself.

5. What you may not do

You may not use the app to film other people without their knowledge, to disrupt, overload or read out the app or our server, to circumvent subscription or usage limits, or to modify and redistribute the app.

6. Further development and availability

We continue to develop the app, add exercises and machines and improve recognition. We will not remove essential features of your subscription during the current term without compensation. Brief interruptions, for example for maintenance, are possible; movement recognition also works without a connection to our server.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent that we have assumed a guarantee. In cases of slight negligence, we are liable only for the breach of essential contractual obligations and limited to the foreseeable, typical damage. Your statutory rights in the event of defects in the app remain unaffected.

8. Right of use

You receive a non-exclusive, non-transferable right to use the app for your own, non-commercial purposes. For apps from the App Store, Apple's standard license agreement (Licensed Application End User License Agreement) applies in addition. Separate agreements apply to gyms and trainers.

9. Data protection

How we handle your data is explained in the FITVYR Coach privacy policy (www.fitvyr.com/coach-privacy).

10. Final provisions

German law applies. If you are a consumer, mandatory consumer protection provisions of the country in which you live remain unaffected. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

If we change these terms, we will inform you in the app in good time beforehand. Changes that disadvantage you apply to a running subscription only from the next renewal; until then, you can cancel.
